An Overview of Personal Bankruptcy
Under Chapter 7, also known as liquidation, you are allowed to fully discharge certain debts in exchange for the sale of non-exempt assets. The proceeds from the sale are distributed among your creditors. Under the new bankruptcy law, enacted in 2005, you must now submit to a means test to determine whether you qualify for protection under Chapter 7. If the court determines that you have the means to repay your creditors over a period of 3 to 5 years, you will be disqualified and may only seek bankruptcy protection under Chapter 13.
If you qualify to discharge your debts under Chapter 7, we will prepare and file all the documents to initiate the proceeding and will represent you in all hearings or proceedings with creditors, the trustee or the bankruptcy court. We will also make certain you understand which debts cannot be discharged in a Chapter 7 proceeding and which of your assets will be exempt from sale.
In a Chapter 13 bankruptcy proceeding, known as reorganization, you enter into agreements with your creditors to restructure and repay your debt over a 3 to 5 year period. Once you have fully repaid your obligations, the bankruptcy will be complete. We will act as your advocate in all dealings with creditors, the trustee and the court, making certain that any repayment agreements you enter into are within your means. If you fail to meet the terms of a repayment agreement, you may lose the protection of the bankruptcy laws.
