An Overview of Bankruptcy
The federal law allows debtors to get relief from the stress and anxiety associated with the repeated attempts to collect on consumer debt. When you file for protection under Chapter 7 or Chapter 13 of the federal bankruptcy laws, an automatic stay immediately goes into effect, prohibiting your creditors from making any further attempts to collect from you, whether by phone, letter or legal action. In many situations, the stay remains in effect permanently, as the debts are either completely discharged by the bankruptcy proceeding or are fully paid off through a restructuring of the debt.
The bankruptcy laws changed in 2005, making it more difficult for individuals to qualify to discharge debts under Chapter 7. Nonetheless, bankruptcy is still available for most people. Whether or not you qualify for a Chapter 7 filing, you can still reap the benefit of the automatic stay and obtain some peace of mind by restructuring your debt.
